License Terms

1. Scope

These terms govern the use of the software SayLocal from Conto IT, Nico Jannis Contopidis, Diebenkornstraße 6, 25524 Itzehoe (“we”). The purchase is handled by Stripe as the merchant; purchase, payment, invoicing and withdrawal are governed by the terms you agree to with Stripe during checkout.

2. Right of use

With a valid license key, you receive a simple (non-exclusive), non-transferable right to use SayLocal personally on up to two of your own devices – for private or professional purposes. The license may not be passed on to third parties, sold, rented out or used jointly by several persons. In companies, each person using the software needs their own license.

3. Trial period

With a trial key, you can use SayLocal free of charge and with full functionality for 3 days from the first activation. One trial is possible per device. The trial period ends automatically; no costs are incurred.

4. Plans

Monthly and yearly: The license is valid for as long as the subscription runs. It renews automatically for the selected term and can be cancelled at any time with effect from the end of the paid term, at getsaylocal.com/konto.
Lifetime: one-time payment, use of all versions 1.x, including their updates, without time limit. A later major version (2.0) may be offered separately.

5. Activation and license check

The license is activated per device. SayLocal checks via the internet once or twice a day whether the license is valid and continues to run without a connection for up to 7 days. You can release devices yourself at getsaylocal.com/konto. SayLocal installs new versions automatically unless you switch this off in the settings. What is transmitted in the process is set out in the Privacy Policy.

6. Not permitted

It is not permitted to circumvent the license check, to publish or pass on license keys, or to modify, reverse engineer or decompile the software, unless expressly permitted by law. In the event of violations, we may block the license.

7. Third-party components

SayLocal contains third-party software and data under their respective licenses, including whisper.cpp and ggml (MIT), the Whisper speech model by OpenAI (MIT) and place data from GeoNames (CC BY 4.0). The notices are included with the app (LIZENZEN.txt).

8. Warranty and liability

The statutory rights in respect of defects apply. Speech recognition is never error-free; check dictated texts before sending them. We are liable without limitation in cases of intent and gross negligence, for injury to life, body or health, and under the Product Liability Act (Produkthaftungsgesetz). In cases of slight negligence, we are liable only for the breach of essential contractual obligations, and limited to the foreseeable, typical damage.

9. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions of the country in which you, as a consumer, have your habitual residence remain unaffected.
